Terms of Service

1. Acceptance

By creating an account or using AutoPodly (the “Service”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

2. What AutoPodly does

AutoPodly automatically converts videos from a YouTube channel or playlist you connect into audio episodes and publishes them to a podcast RSS feed you can submit to podcast platforms such as Spotify.

3. Your responsibilities & content ownership

  • You may only connect a YouTube channel or playlist that you own or are fully authorized to distribute as a podcast. You represent and warrant that you hold all rights, licenses, and permissions necessary to publish the resulting audio, including any music, third-party material, or guest contributions it contains.
  • You agree to comply with the YouTube Terms of Service, the policies of any podcast platform you distribute to, and all applicable copyright and other laws.
  • You are responsible for safeguarding your account credentials and for all activity under your account.
  • You may not use the Service to infringe anyone’s rights, distribute unlawful, defamatory, or harmful content, or abuse, overload, or attempt to disrupt the Service.

4. License you grant us

Solely to operate the Service for you, you grant AutoPodly a limited, non-exclusive license to access, download, convert, store, host, and distribute the audio of the videos you select, and to use your channel and podcast metadata, for the purpose of generating and serving your podcast feed. You retain all ownership of your content. This license ends when you delete the content or your account, except for copies retained as required by law or already distributed to third-party platforms at your direction.

5. Indemnification

You agree to defend, indemnify, and hold harmless AutoPodly and its operators from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) content you connect, publish, or distribute through the Service; (b) your violation of these Terms or any law; or (c) your infringement of any third party’s intellectual property, privacy, or other rights. You — not AutoPodly — are responsible for ensuring you have the rights to everything you publish through the Service.

6. Copyright complaints (DMCA)

We respect intellectual property rights and respond to valid notices of alleged infringement. If you believe content distributed through AutoPodly infringes your copyright, email us at autopodly@gmail.com with: (1) identification of the copyrighted work; (2) the specific feed or episode at issue; (3) your contact information; (4) a statement that you have a good-faith belief the use is not authorized; (5) a statement, under penalty of perjury, that your notice is accurate and you are the rights holder or authorized to act on their behalf; and (6) your signature. We will remove or disable access to infringing material and may terminate accounts of repeat infringers.

7. Subscriptions & billing

Paid plans are billed on a recurring basis through our payment processor. You can cancel at any time; cancellation stops future billing and takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.

8. Service availability

AutoPodly relies on third-party services (including YouTube and podcast platforms). We do not guarantee uninterrupted or error-free operation and are not responsible for changes those third parties make that affect the Service.

9. Disclaimers & limitation of liability

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, AutoPodly and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the three months before the claim.

10. Termination

You may stop using AutoPodly and delete your account at any time. We may suspend or terminate accounts that violate these Terms, infringe others’ rights, or create risk or legal exposure for us or other users.

11. Governing law

These Terms are governed by the laws of the United States and the state in which the operator of AutoPodly resides, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to arbitration or small-claims resolution.

12. Changes

We may update these Terms from time to time. Continued use after an update means you accept the revised Terms.
